For any case that starts in District Court, the defendant can have a trial before a judge and if convicted can appeal the case to Circuit Court. At Circuit Court, the case is heard de novo, which means the defendant can get a whole new trial. A dedicated Montgomery County criminal defense lawyer may try the case in District Court, lock the officers down on certain testimony, and then use the transcript from the original trial to the defendant’s advantage in Circuit Court.
Because potential loss of liberty always exists in a criminal case, if arrested in Montgomery County, it’s critical to find and hire experienced criminal defense attorneys.
